Trademark and Design Re-registration in Montenegro
The new Trademark Law entered into force in Montenegro on December 16, 2010,
while the new Design Law entered into force on January 8, 2011.
These laws introduce an obligatory re-registration of trademarks/ designs
registered before the IP Office of Yugoslavia/ Serbia & Montenegro/ Serbia
prior to May 28, 2008, unless a renewal or request for recordal of changes
or Certificate of Registration had already been filed in Montenegro before
December 16, 2010/ January 8, 2011 (date of entry into force of the relevant law).
However, these rules does not relate to International Registrations
registered before the WIPO.
Serbia became member of the European Patent Organization
The Republic of Serbia has become the member of the European Patent Organization (EPO)
on October 1, 2010. In such a way, Serbia joined the family of the European countries members
of this organization, including all 27 members of the European Union, and also Albania, Croatia,
Macedonia, Island, Lichtenstein, Monaco, Norway, San Marino, Switzerland and Turkey.
On the basis of this accession to the EPO, Serbia got full membership in the committees and
working bodies of this Organization. In such a way, Serbia is actively participating in the
development of the patent system in Europe.
Extension of European Patents and Patent Applications
The Co-operation and Extension Agreement in the field of
patents between Montenegro and European Patent
Organization entered into force on March 1, 2010. From
this date it will be possible to extend the protection
conferred by European patent applications and patents to
Montenegro without any additional examination. Extended
European patent applications and patents will enjoy
essentially the same protection in Montenegro as the
patents granted by the European Patent Office for the
member states of the European Patent Organization.
